This is intended to be a legally binding agreement. If you do not fully understand, seek the advice of an attorney before signing
Company agrees to conduct an inspection of the subject premises for the purpose of informing the Customer of noticeable visual deficiencies in the condition of the subject premises which could significantly affect the value of the property. The inspection and report are performed and prepared for the sole, confidential and exclusive use and possession of the customer.
This inspection is performed in accord with the STANDARDS OF PRACTICE of the National Association of Home Inspectors (NAHI) a copy of which the inspector has given you, and they are a part of this report. These guidelines are intended to provide the client with a better understanding of the property conditions as observed at the time of the inspection. We report visible defects (based upon non-invasive visual observation only) apparent on the day of the inspection.
It is understood and agreed that this inspection will be of readily accessible areas of the structure and is limited to primarily visual observations of apparent conditions existing at the time of the inspection. Soil conditions, geological stability, or engineering analysis are beyond the scope and purpose of this inspection. Cosmetic items are not included in this report. Additional clarification of the purpose and scope of the inspection as well as general limitations and exclusions are included in the STANDARDS OF PRACTICE.
The inspector has no present or contemplated future interest in the property described by his inspection report. The inspector has no personal interest in or bias with respect to the subject matter of the inspection report or the participants to the sale.
The inspection is not based in a whole or in part upon the race, color, or national origin of the current or prospective owners or occupants of the inspected property or occupants of the properties in the vicinity if the property inspected.
To the best of the inspectors knowledge and belief, all statements and information in this report are true and correct, and the inspector has not knowingly withheld significant information. The inspection is furnished on an opinion only basis and is made solely for the information of the customer. The inspection and report are not intended or to be used as a guarantee or warranty, expressed or implied. This report is not an insurance policy that items found acceptable will remain so for any period of time, nor that every defect will be discovered. The customer agrees to accept all the risk for hidden, inaccessible, latent or concealed defects. The inspection is not a compliance inspection or certificate for past or present governmental or local codes or regulations.
The inspection encompassed by the report does not include an inspection for pests, an inspection for the presence or absence of hazardous and toxic materials or substances, including but not limited to environmental hazards, radon gas, mold, carbon monoxide, lead paint, urea formaldehyde, toxic or flammable chemicals and water, underground tanks or airborne hazards, an inspection for the quality of water, an inspection for the quality or expected longevity of construction materials. It does not include air quality or the presence or absence of asbestos or the type of insulation.
The inspection is a visible inspection of the readily accessible areas of the property, at the time of the inspection. The Inspector is not required to move furniture, personal goods or equipment which may impede access or limit visibility. The Inspector is not required to evaluate the condition or presence of storm windows, storm doors, shutters, awnings, and other such accessories, or to determine their functional efficiency. No destructive or disruptive testing procedures are performed by the Inspector. Design problems and adequacies are not within the scope of the inspection. The Inspector will not determine the operational capacity, quality or suitability for a particular use of the items inspected. The inspection does not determine compliance or noncompliance with manufacturers specifications; past or present. Detached buildings are not inspected unless specifically included.
The inspection is not intended to identify defects within walls, beneath foundations and slabs, or otherwise hidden defects not visible through reasonable diligence of the inspector.

The inspector accepts no responsibility for the reporting of any cosmetic defects which may be present before, during, or after the inspection. This includes, but is not limited to, foggy window panes, defective carpet, non-structural cracks and scratches, painting requirements when structural damage is not imminent, and other minor defects which have no bearing on the structural integrity of the space.
The inspector cannot provide any repair services to the existing structures within the subject property.
Also excluded are inspections and reports on swimming pools, wells, septic systems, security systems, central vacuums systems, sprinkler systems, fire and safety equipment, unattached structures, storage structures and the presence or absence of rodents or pests, wood destroying insects, other insects, intercoms, fences, timers, safety glass, backflow preventers, and water conditioning equipment are not inspected or evaluated
The parties agree that All Aspects Inspections inc. (the company,) and its employees and agents, assume no responsibility for the cost of repairing or replacing any unreported defects or deficiencies, either current or arising in the future, or for any property damage, consequential damage or bodily injury of any nature.
This inspection and report are not intended to be used as a guarantee or warranty, expressed or implied, regarding the adequacy, performance or condition of any inspection structure, item or system. The Company is not an insurer of any inspected conditions.
The report is intended for the use of the below named customer and no other person or entity may rely on the report for any reason. Customer agrees to hold harmless and indemnify the Company for losses, fees and costs incurred as a result of any third party action which may include the Company relative to the report. Furthermore, any third party reviewing this report for any reason shall be bound by the terms and conditions of the Inspection Agreement which is an integral part of the report. Customer understands and agrees that if they are not present at the time of the inspection and therefore do not sign this Agreement and/or a representative/agent signs the agreement on their behalf that this agreement will form a part of the inspection report and acceptance of the inspection report by Customer shall and payment therefore will constitute acceptance of the terms and conditions of this agreement.
Standard Arbitration Clause: Any controversy or claim arising out of, related to, or in connection with this contract, or the breach thereof, shall be settled by arbitration in accordance with the Construction Industry Rules of the American Arbitration Association, and judgement upon the award rendered by the arbitrator (s) may be entered in any court having jurisdiction thereof. Reasonable attorneys fees and costs shall be awarded to the prevailing party in any dispute arising under the terms and conditions of this contract and the parties agree that the arbitrator shall be entitled to grant such award.
The customer agrees to notify the company by telephone and in writing of any item in question, and allow the Inspector access to the property to evaluate these items before any correction action is taken. The customer agrees and understands that any repairs or corrective action without consultation with the company relieves the company of any and all liability
It is understood and agreed that should the company and/or its agents or employees be found liable for any loss or damages resulting from a failure to perform any of its obligations, including but not limited to negligence, breach of contract or otherwise, then the liability of the company and/or its agents or employees, shall be limited to a sum equal to the amount of the fee paid by the customer for the inspection and report. In the event any provision of this agreement is determined to be invalid or unenforceable, the other provisions shall remain valid and enforceable and in full force and effect.
Acceptance and understanding of the Agreement is hereby acknowledged.

Technically Exhaustive Inspection
The customer is advised the there is a technically exhaustive inspection available without the liability limit of the visual inspection, and that the minimum fee for this type of inspection is $5,000.00. Homes larger then three bedrooms, one kitchen, two bath or property larger then one quarter acre will cost more. The Company will retain other specialists as necessary and be prepared to prepare a technically exhaustive report within twenty days of the date of request, in writing, for this service accompanied by a 50% deposit required to commence this inspection.
